Happy at SUNY but ready for a new career challenge?

UUP members looking to transfer to vacancies at other SUNY colleges or universities are urged to review their rights under Article 34 of the 2007-2011 bargaining agreement between UUP and New York state.

Article 34 (Transfer Rights) answers the key questions members may have when transferring among colleges within the University. For instance, the contract clearly states that employees cannot be transferred without their consent; will not lose their contractual rights because of a transfer; and will be credited with the compensatory, sick and vacation leave accruals they had on the date of transfer.

In addition, employees who transfer with a department, program or other unit from one SUNY campus to another will receive the following benefits, to the extent permitted by applicable law, rule or regulation. Employees:

• Retain the same title and salary that they held on the date of transfer;

• Receive the seniority for purposes of retrenchment as they held on the date of transfer;

• Retain continuing or permanent appointment if they held that appointment on the date of transfer; and,

• Who held a term appointment on the date of transfer will be granted a new term appointment for a duration of not less than the unexpired time of the previous term appointment held on the date of transfer, and will be credited with all prior continuous service in the University, up to a maximum of four years, for the purposes of eligibility for permanent or continuing appointment.

The contract also includes provisions for how employees become aware of vacancies within SUNY. Under the current pact, the University must provide UUP with copies of vacancy announcements pertaining to academic and professional positions within the bargaining unit, and each campus must develop and maintain procedures for publicizing vacancy announcements, including using the Internet.
